Agreement to Terms
By accessing, browsing, or using skywayfriends.orgor any related application or interface (the “Service”) in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, you must immediately cease all access and use of the Service.
About the Organization
References on this page to “the Organization” mean the unincorporated community group operating under any of the names “Friends of the Saint Paul Skyway,” “Friends of the Skyway,” “Skyway Friends,” “FOS,” or any similar or successor wordmark, brand, or trade name associated with the volunteer effort to preserve and expand the Saint Paul skyways and that is not associated with Jacob Ramos or Open-Civ. The Organization is a community group, not a 501(c) nonprofit corporation, and is distinct from Jacob Ramos and Open-Civ. The skywayfriends.org domain, the platform on which it runs, and the social-media accounts that promote it are owned by Jacob Ramos and Open-Civ (see the “Domain,” “Platform & software,” and “Social media accounts” sections below) and are not part of the Organization.
Domain
The skywayfriends.org domain name and the associated DNS configuration are owned by Jacob Ramos and Open-Civ. The domain is used by the Organization with the owners’ permission. Ownership of the domain does not transfer to the Organization.
Social media accounts
The social-media accounts that promote skywayfriends.org — including without limitation facebook.com/skywayfriends, instagram.com/skywayfriends, tiktok.com/@skywayfriends, x.com/spskywayfriends, and any successor or related handle — are owned and operated by Jacob Ramos and Open-Civ. Account credentials, posting history, follower lists, analytics, and any content the account owners post or have ever posted are the property of Jacob Ramos and Open-Civ. The Organization may submit content for posting and may use the accounts under license, but ownership of the accounts themselves does not transfer and may be revoked at any time by written notice from Jacob Ramos.
Platform & software
The skywayfriends.org platform — including the site source code, design, layout, database schema, SQL, server logic, RPC functions, and APIs — is © Jacob Ramos and Open-Civ, all rights reserved. All right, title, and interest in the platform itself, including all associated intellectual-property rights and all SQL and database structure, are owned solely and exclusively by Jacob Ramos and Open-Civ and are retained by them.
The platform is provided to the Organization under a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to host and operate the organization’s website on it. That license does not transfer any ownership of the platform, the code, the design, the schema, or the SQL, and may be terminated at any time by written notice from Jacob Ramos.
Member & organization data
Membership records, donor records, registration data, volunteer information, survey responses, event ideas, submitted photographs, and uploaded library documents — collectively, the data submitted by or on behalf of the Organization and its members — are jointly owned by the Organization, Jacob Ramos, and Open-Civ. Each party may use the data in connection with the organization’s mission and the operation, maintenance, and improvement of the platform.
Personal information shared with the platform is handled per the Privacy Policy. Joint ownership of the records does not affect the privacy commitments described there.
Trademarks & brand
“Friends of the Saint Paul Skyway”, the associated wordmark, and the organization’s brand are owned by the Organization and are used on this site by the organization. They are not owned by Jacob Ramos or Open-Civ.
Skyway Library documents
The Skyway Library reproduces public-record documents (easement agreements, governance filings, and other materials available from the City of Saint Paul or filed publicly elsewhere). Those underlying documents remain the property of their respective authors and are presented here for public-interest reference only.
Acceptable use
When you use the Site you agree not to:
- Use the Site to harass, threaten, defame, or impersonate any person, or to violate any applicable law.
- Reverse engineer, decompile, scrape at scale, or otherwise attempt to extract the Site’s source code, design, or schema except to the extent expressly permitted by law.
- Submit malware, spam, automated bulk submissions, or content you do not have the right to share.
- Interfere with the Site’s operation, attempt to bypass authentication, or access data that is not intended for you.
We may suspend or terminate access for any user who violates these terms.
Disclaimer
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that the Site will be uninterrupted, error-free, or secure, and we do not warrant the accuracy or completeness of any information on it, including any document reproduced in the Skyway Library.
Limitation of liability
To the maximum extent permitted by law, neither Skyway Friends, Inc., Jacob Ramos, nor Open-Civ will be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or in connection with your use of the Site.
Governing law
These terms are governed by the laws of the State of Minnesota, without regard to its conflict-of-laws rules. Any dispute arising from your use of the Site will be resolved in the state or federal courts located in Ramsey County, Minnesota, and you consent to the personal jurisdiction of those courts.
Changes to these terms
We may update these terms from time to time. The current version is always available at skywayfriends.org/legal. Material changes will update the “Last updated” date at the top of this page. Continued use of the Site after an update means you accept the revised terms.
